Securities Fraud

Securities Fraud is on the Rise

The U.S. Department of the Treasury’s Financial Crimes Enforcement Network publishes a Suspicious Activity Report (SAR) twice yearly to shed light on practices in the financial services and related industries.

The most recent report notes that “since the inception of mandated reporting by the securities and futures industry in 2003, SARs filed by this industry have grown every year.”

In the first half of 2010, reports were up 2% over the same period in 2009.

Filings characterizing suspicious activity as securities fraud were up 37% over 2009 figures.

Suspicious activity involving stocks rose by 51% when compared with the first half of 2009.

A security is an investment instrument – a stock or bond, for instance. When individuals or organizations invest in securities, they do so with the hope of growing their money. However, unscrupulous individuals or corporations may try to trick investors into buying securities based on false information about companies, about an instruments’ earnings potential, or other factors. If you have been the victim of securities fraud or if you or your company are charged with securities fraud, you’ll want to consult a qualified securities fraud attorney for advice.

The New York securities fraud lawyers at The Law Offices of Newman & Drukman have a comprehensive understanding of the financial services industry and of the investment options it offers. Our attorneys recognize that regulations applicable to brokers and financial institutions are complex, and that the investment process can seem intimidating and confusing to some investors.

It is that very complexity that fraud perpetrators rely on, gambling on the possibility that investors may not fully examine offerings before they purchase them. They may add time pressure, convincing the investor that a buying decision must be made rapidly if the promised returns are to be realized.

At The Law Offices of Newman & Drukman, our veteran New York securities fraud lawyers have seen the devastation caused by inappropriate or questionable action on the part of investment advisors or brokerage firms.
